We have met with FDSB yesterday and the good news is, they agree to waive the interests charge to some residents if they pay up before this 31/12/2009!

"Gated/Guarded" Community; An opinion piece from our neighbors in USJ

Dear All,
 
In an earlier post I had mentioned that we at Puchong Hartamas should be glad we have more than most other communities (Supplementary Agreement, guard house, perimeter wall/fence, etc) when setting up a "guarded/gated" community. It is up to us to optimize our advantage and be cohesive.

Deed of assignment for hand over security services

Our appointed lawyer has drafted the Deed of Assignment for PHRA to take over the security services according to plan. Here is the almost complete draft for your reference.

 

 

DEED OF ASSIGNMENT

THIS DEED OF ASSIGNMENT is made the day of 200… BETWEEN FIVESTAR DEVELOPMENT (PUCHONG) SDN BHD (Company No. 368625-V) of Bangunan Tan Lai Kim, No. 160, Batu 3 ¼, Jalan Kelang Lama, 58000 Kuala Lumpur (hereinafter called “the Assignor”) of the part and PUCHONG HARTAMAS RESIDENT ASSOCIATION, an association form in Malaysia and having its address at No. 30, Jalan PH 2/1, Taman Puchong Hartamas, 47100 Puchong, Selangor (hereinafter called “the Assignee”) of the other part.

WHEREAS

  1. By Supplemental Agreement executed by the Assignor and the Purchasers of the property in the housing development known as “PUCHONG HARTAMAS” [hereinafter called “the Supplemental Agreement”] the Assignor had agreed to provide the facilities and services as define in the Supplemental Agreement details of which are more particularly described in the Supplemental Agreement and upon the terms and conditions therein contained.

  1. Pursuant to Clause 1.5 of the Supplemental Agreement, the Assignor has agreed to assign and transfer all of the Assignor’s rights, title and interests in Supplemental Agreement together with any surplus of payment made by the Purchasers of the Property to the Assignor and the money/payment which has been deposit in the escrow account and the Assignee has agreed to accept the same SUBJECT TO the conditions those hereinafter appearing.

  1. The Assignor has agreed to assign, transfer and conveys ABSOLUTELY unto the Assignee the Assignor title, interest, benefit, advantage, property, claim and demand whatsoever of the Assignor in or to the same together with the entire rights and benefits of all the stipulations contained in the Supplemental Agreement and all remedies for enforcing the same and the Assignee accepts this Assignment.

NOW THIS DEED OF ASSIGNMENT WITNESSETH as follows: -

  1. The Assignee hereby covenant with the Assignor that the Assignee shall pay perform and observe the stipulations agreements provisions and conditions which are mentioned or contained in the Supplemental Agreement and shall perform and observe the terms conditions of the Supplemental Agreement or otherwise in relation thereto.

  1. In amplification and not in derogation of the matters hereinbefore expressed and set forth the Assignee hereby expressly agree and confirm that SUBJECT only to the express terms and modification contained in this Assignment, the Assignee shall assume all the sundry obligations and liabilities and shall be entitled to all whatsoever benefits, rights, title and interests imposed upon or vested in the Assignor by under or pursuant to the Supplemental Agreement as fully and effectively as if the Assignee had been the sole party in the Supplemental Agreement in place of the Assignor.

  1. The Assignor hereby covenants with the Assignee that the Assignor has not in any way or manner whatsoever committed any breach or non-observance of any of the covenants, stipulations, terms and conditions of the Supplemental Agreement prior to and including the date of this Assignment.

  1. The costs of and incidental to the preparation and completion of this Deed of Assignment including the stamp duty, if any, shall be borne and paid for solely by the Assignee.

  1. Time wherever mentioned in this Deed of Assignment shall be deemed to be of the essence of this Agreement.

  1. This Agreement shall be binding on the personal representatives and permitted assigns of the Assignor and the Assignee.

IN WITNESS WHEREOF the parties hereto have hereunto set their hands the day and year first above written: -

Resignation as Secretary of PHRA

I am Yap Boon Huan, the ex-secretary of the PHRA for the 2009/2010 committee. I resigned from my position as secretary on 26.10.2009. Today I received a call from a committee member of the present committee of the PHRA requesting that I continue to sign cheques for the PHRA until an AGM has been called and a new bank account is opened and the monies from the present account is transferred to the new account.

I have declined to sign any more cheques as I am no longer the secretary and neither am I a committee member of the PHRA. A copy of my resignation e-mail is reproduced below:

New security fees to collect

Your PHRA has dropped a notice in your mailbox recently about how to make payment for new security fees. The fees cover 3 months deposit and 2 months advanced payment. This give total RM250.

Please make your payment now to Ms Angela Tan as mentioned in notice. A copy of the notice is attached below.

Here is the important information for quick access:

Amount to pay: RM250
For: New 3 months security deposits + 2 month advanced
Payee Name: Persatuan Penduduk Taman Puchong Hartamas, Fasa 1
Address: No. 11, Jalan PH 2/5, Taman Puchong Hartamas, 47100 Puchong.
For check payment: Please drop into mailbox at the address above. Remember to write your name, house address and your contact number behind the check.
For cash payment: Please go to the address above on Sat and Sun, 4pm - 7pm.

Your PHRA will arrange with developer to return your previous payments. Your old deposits will be used to deduct the outstandings. If there is excess, it will be returned to you promptly. If there is shortage, you will need to clear the outstandings.

Your PHRA has also engaged lawyer to draft the hand over document on the Security Management Services based on Supplementary Agreement. See attached draft. More meetings are scheduled with lawyer to further fine tune the draft with information such as collection and escrow account.

Referendum of Saturday evening
